New Delhi:  The Congress today once again boycotted the meeting of the Lokpal Selection Committee with its leader in Lok Sabha Mallikarjun Kharge saying that he was invited by the government as a ‘special invitee’ with the singular intention of excluding the opinion of the opposition in the selection process.

Mr Kharge shot off a letter to Prime Minister Narendra Modi declining the offer to attend the meeting and alleged that his government has not accorded priority and importance to the issue and its “double standards” stood exposed.

He alleged that the process of appointing the Lokpal under such circumstances would be vitiated if the voice of the opposition is not included.

“Inviting the leader of single largest opposition party as a ‘Special Invitee’ is done with the singular intention of excluding the opinion of the opposition from the selection process of Lokpal,” he said in his letter 

Mr Kharge had on March 1 written a similar letter to the prime minister while boycotting the earlier meeting of the Lokpal Selection Committee as a special invitee’.

He had said that a special invitee invitation is a concerted effort to exclude the voice of the opposition in Lokpal selection.

In his latest letter, the Congress leader said “it is deeply disappointing that not only did the earlier letter go unacknowledged, but also the serious concerns that were raised in that letter continue to go unaddressed as seen by the issuing of the latest office memorandum from DoPT (Department of Personnel and Training)”.

The Congress leader said the government is aware that there is no provision in the Lokpal and Lokayuktas Act for a ‘special invitee’ without rights of participation, recording of opinion and voting in the procedure and it has been done only to “mislead” the nation and the people, rather than sincerely seeking the participation and opinion of the opposition.

“Therefore, to participate in this charade while your government runs roughshod over the intent and spirit of the Lokpal Act would amount to dereliction of my constitutional duty,” he said.

Mr Kharge said the people of the nation should know that the government has wasted four precious years in the fight against corruption by not amending the Lokpal Act to include the leader of single largest opposition party in the Lok Sabha as a member of the selection committee under the said Act.

“This would have established the bona fides of the government in fighting corruption before the people,” he said.

“If the government is, indeed, serious about ensuring that the Lokpal is appointed with the sanctity it deserves, I would once again suggest that the government bring in the necessary amendment by way of an ordinance to include the voice of the opposition in this process.

“Under these circumstances, I must once again respectfully decline the invite as ‘special invitee’ to prevent any dilution of the letter and spirit of the Lokpal Act, 2013,” Mr Kharge said in his letter to the prime minister.

Mr Kharge said the government’s “double standards in this matter stand exposed” as a similar amendment was made to Delhi Special Police Establishment Act in 2014, where leader of the single largest opposition party was made a member of the Selection Committee for the appointment of director of the Central Bureau of Investigation.

“It is apparent that the appointment of the Lokpal has not been accorded the same degree of importance or priority by your government,” he said.

The Congress leader told the prime minister that he would be aware that the amendment bills to the Lokayukta Act to include the leader of single largest opposition party in the selection committee were moved and even approved by the select committee. “Yet till date your government has never bothered to list the same for debate or voting,” he said.

“It is clear that the current exercise is merely perfunctory gesture to assuage the letter of the Supreme Court’s direction,” he said.

Mr Kharge urged the government to amend the Act to include the leader of single largest opposition party in the selection committee and bring an ordinance in this regard.

“The repeated conduct of the government in this matter both in the Supreme Court and now during this process of appointment defeats the intent to honour the letter and spirit of the Lokpal Act,” he said.

Asked at the AICC briefing, Congres leader Pawan Khera said “this is a clear case of this government trying to sabotage the institution of Lokpal.” 

As per the Lokpal and Lokayukta Act, 2013, only the leader of the opposition (LOP) in Lok Sabha is a member of the Selection Committee and since Mr Kharge does not have that status, he is not a part of the panel. A party should have at least 55 seats or 10 per cent of the strength of the Lok Sabha for its leader to get the LOP status.

New Delhi:  The Employee Provident Fund Organisation (EPFO) has asked banks not to deny monthly pension to the people for want of biometric national ID, Aadhaar, and said that alternate means for identification should be used if needed.

The EPFO, in a circular to all heads of pension disbursing banks and postal services, on Monday listed out alternate mechanism of handling pensioners who do not possess Aadhaar or those whose identity cannot be authenticated due to wear out of fingerprint.

It asked banks to ensure that pensioners are facilitated for Aadhaar enrolment and a paper life certificate is accepted, in place of a digitally generated one, for pensioners who have enrolled for Aadhaar.

For those whose fingerprint wear out has made authentication difficult, banks will make provisions for IRIS scanner along with the fingerprint scanner in bank branches, it said.

EPFO said the agreement it signed with banks for disbursement of pension lays down the duties and responsibilities of banks including collection of Life Certificate/Non-re-marriage certificate in November every month from pensioners and forwarding the same to EPFO field offices for necessary action.

Concerned branches of the banks were doing this by collecting Life Certificate in paper form.

But since 2016, the Life Certificates are being obtained from the pensioners digitally as Jeevan Pramaan in place of the Life Certificate in paper form being submitted by the pensioners to the bank earlier. Submission of Jeevan Pramaan digitally has been facilitated through UMANG APP in the mobile phones also.

“Some complaints have been received from pensioners who are being turned away and denied pensions for want of Aadhaar or Aadhaar fingerprint authentication not being successful due to poor fingerprint of the beneficiary or due to network/ connectivity or other technical reasons. Because of this, pensioners are not able to get and submit Jeevan Pramaan,” the circular said.

For giving pension to the pensioners who cannot get and submit Jeevan Pramaan on account of not possessing Aadhaar, EPFO asked banks to ensure that such pensioners are facilitated for Aadhaar enrolment. “Banks should also make special arrangement for the bed-ridden, differently abled, or senior citizens who are unable to visit the Aadhaar involvement Centre,” it said.

Till such time Aadhaar is assigned to such pensioners, a paper life certificate may be accepted after collecting Aadhaar enrolment application receipts from such pensioners. “After due verification through alternate identification documents as deemed necessary by the bank, pensions may be disbursed,” it said.

An entry with necessary details such as paper life certificate, Aadhaar enrolment application receipts and the like may be recorded “in an exception register which should preferably be maintained in an electronic form”. it said.

For giving pension to the pensioners whose fingerprint authentication fails for any reason, EPFO asked banks to make provisions for IRIS scanner along with the fingerprint scanner in bank branches.

“It has been observed that in many cases IRIS authentication is successful even though finger print authentication may have failed. This is particularly true for many senior citizens. In such cases, digital life certificate may be generated on the basis of IRIS authentication and pension may be given,” it said.

In case where finger print or IRIS authentication is not feasible for any reason, an entry should be made in the exception register with reasons and pension may be provided on the basis of paper life certificate and physical Aadhaar card or E-Aadhaar card of the pensioner after due verification as deemed fit by the bank.

“The exception register which would contain the details of exception granted alongwith paper life certificate, Aadhaar number or Aadhaar enrolment ID etc, maybe reviewed and audited periodically by senior management of the bank,” the circular said.

CBSE To Conduct Postponed Exams In Punjab On April 27

New Delhi:  CBSE Classes 10 and 12 examinations cancelled due to Bharat Bandh on April 2 in Punjab now will be held on April 27. A statement from the board said the exams had to be cancelled, and the Board has now decided to conduct the cancelled examinations on April 27, 2018 (Friday) for candidates of the state of Punjab For Class 10 and 12.

According to Central Board of Secondary Education (CBSE), Roll Numbers and Examination Centres already allotted to the students will remain same.

At the request of the state government in view of ‘Bharat Bandh’ called by several Dalit organisations against the alleged “dilution” of the SCs/STs (Prevention of Atrocities) Act, the CBSE had postponed the exams scheduled on April 2.

The board officials, had said yesterday, that the dates will be announced soon.

“The dates will be announced soon, students and parents should not panic,” a senior CBSE official said.

While Class 12 students in Punjab have to appear for the Hindi, Gujarati, Nepali and Kashmiri exams, language exams of French, Sanskrit and Urdu are re-scheduled for Class 10 on April 27.

The board had said that it had received a letter of request, dated April 1, 2018, from the director general (school education) of the Punjab government to postpone all its examinations scheduled to be held on April 2, on account of apprehensions of law and order problems and other disturbances in the day during the ‘Bharat Bandh’.

The Morrocan newspaper has claimed that 43 generations of Queen Elizabeth’s family have been traced to produce the research finding that the Queen is a distant relative of the Prophet.

The study claims Elizabeth II’s bloodline runs through the Earl of Cambridge in the 14th century, across medieval Muslim Spain, to Fatima, the Prophet’s daughter. The claim is disputed by some historians, but the genealogical records of early-medieval Spain support it. According to reports, Ali Gomaa, the former grand mufti of Egypt, also endorsed it.

2. “Women Who Dress Like Men Give Birth To Transgenders”: Kerala Professor

A professor in Kerala who is a regular at government programmes generated waves of shock and disgust with his comments on transgenders. In a clip that was widely circulated on social media, Professor Rajith Kumar is heard saying, “Women, who wear men’s clothes, give birth to children called transgender – Hijra. More than six lakh such children have been already been born in Kerala… If women insult their womanhood and men insult their manhood, children born to them, though may appear to be a girl, will have the nature of a man. And this woman will later conceive a child called transgender. Such children are being born with cerebral palsy, autism.”  The professor, a doctorate in microbiology, faces the prospect of being blacklisted by the government for his comments.

3. Train Travels Without Engine For 10 Km, People Screamed To Alert Passengers

Close to 1,000 passengers were in a train that rolled on for nearly 10 kilometres without its engine in Odisha on Saturday night. A video clip shows 22 engine-less coaches of the Ahmedabad-Puri Express speeding past a railway platform as helpless onlookers screamed and yelled at passengers to pull the train’s emergency brake.

As soon as the Railways staff noticed the train’s untimely movement, they rushed to place stones on the track and managed to bring it to a halt.

4. A Woman Was Found Half-Decomposed, Crawling With Maggots – And Still Alive

A bedridden woman in her 50s, identified as Tracie Sorrells, was found living in squalor in her home in northern Georgia, partly decomposing and covered in cockroaches and maggots. Authorities described the scene as “deplorable,” with garbage piled nearly to the ceiling, roaches scaling the walls and the woman – bedridden and obese – showing signs of decomposition on her legs, according to an incident report from the Gwinnett County Police Department. Her husband, Terry Sorrells, 54, and their son, Christian, 18, were arrested and charged with neglect of a disabled or elderly person, a felony offense.

5. Bihar University Issues Admit Card With Bikini-Clad Woman’s Photo

In a peculiar incident, a final-year woman student of the Bihar university’s affiliate SMJ College in Madhubani, about 145km from state capital Patna, found the photo of a woman in lingerie on her admit card, Hindustan Times reported.  This is the second time that the Darbhanga based university is news for the same reason. Last year, a first-year student from Lalit Narayan Mithila University’s JN College in Darbhanga was amazed to see Lord Ganesha’s picture on his admit card. A BCom (Honours) student at Lalit Narayan Mithila University’s JN College in Darbhanga was issued an admit card that had the picture and signature of the Hindu god then.

Shahjahanpur:  A woman was severely beaten by her husband and in-laws in Uttar Pradesh’s Babra village allegedly for not bearing a male child. Rekha Devi, 30, whose hands were fractured in the beating, had given birth to three daughters during her eight years of marriage which upset the family, police said.  

They also kept her in captivity and barred her from speaking to her parents, police said.

Fortunately, Rekha Devi’s parents recently dropped by for a visit and learned about the situation. Finding her in an injured condition, they took her to the hospital and lodged an FIR against her husband and in-laws, police said. Rekha was married to Shailandra Kumar eight years ago.

“The woman has suffered serious injuries and we are waiting for the medical report. Action will be taken against the suspects,” Superintendent of Police Subhash Chandra Shakya said.

The series of abuse started after Rekha Devi gave birth to a third daughter couple of months ago, Mr Shakya said. On March 30, Shailandra, his brother, Jitendra Kumar, and other members of the family beat her up, fracturing both her hands. She was again assaulted on April 4, police said.

A complaint was lodged against Shailandra, his brother, Jitendra, his father, Dataram, and mother, Reshma Devi. The four were booked under section 325 (punishment for voluntarily causing grievous hurt to someone) of the IPC and various sections of the Protection of Women from Domestic Violence Act and the Dowry Prohibition Act, Mr Shakya said.

Patna:  On a day Prime Minister Narendra Modi praised Bihar Chief Minister Nitish Kumar for doing a good job in his drive against corruption, the Central Bureau of Investigation (CBI) questioned former Chief Minister Rabri Devi in connection with an alleged hotel scam case when her husband Lalu Prasad was railway minister.

After Rabri Devi refused to go to the CBI office for interrogation, a team of officials questioned her for over four hours at her residence in Patna in a case related to alleged corruption in giving a contract for running two railway hotels to a private firm in 2006.

In July last year, the CBI lodged a case against Lalu Prasad, his wife and his son Tejashwi Yadav among others in a case that alleges Lalu Yadav as railway minister handed over the maintenance of two hotels run by the Indian Railway Catering and Tourism Corporation in Ranchi and Puri to Sujata Hotel, a private company, in return for a prime plot of three acres in Patna through a benami company.

The CBI FIR alleged that the RJD chief abused his official position as railway minister for giving undue favours to the private company and acquired a “high value premium land” through a benami firm Delight Marketing Company.

After the tender was awarded to Sujata Hotel, the ownership of Delight Marketing was changed in favour of Rabri Devi and Tejashwi Yadav between 2010 and 2014.

The CBI has earlier questioned Lalu Prasad and his son in the case. The RJD chief who has been convicted in another corruption case and sentenced to jail is now under medical treatment in Delhi.

Accusing the BJP of using the CBI against its political opponents, the RJD has alleged that the interrogation was timed on a day PM Modi was in Bihar and shared the stage with Nitish Kumar.

“The CBI went ahead and filed an FIR though its own legal wing said a case wasn’t made out. It’s a clear case of political vendetta. We are not afraid. Tejashwi Yadav has already dared the CBI to file a charge sheet. Why hasn’t the agency filed it?” asked RJD Spokesperson Shakti Yadav.

In July last year, Nitish Kumar pulled out of the grand alliance over corruption allegations against Tejashwi Yadav and his family members, joining hands with the BJP to form the government.

BJP president Amit Shah will also join the protest, but he will be in Karnataka, where the campaign is in full swing for polls that are a month away. 

The BJP has blamed the Congress and Sonia Gandhi for the disruptions that meant that the budget session of parliament was a lost cause.

“The PM will work in his office but will not eat,” said a BJP leader.

The BJP had announced last week that all its lawmakers would observe a day’s fast against parliament disruptions, but the Prime Minister’s participation was confirmed today. 

Yesterday, Rahul Gandhi led a Congress fast at Mahatma Gandhi’s memorial Rajghat to highlight communal harmony and what the party called the government’s failure to control violence during Dalit protests.

New Delhi:  The National Human Rights Commission or NHRC has sent a notice to the Uttar Pradesh government and the state police chief seeking a detailed report on the death of the father of an alleged gangrape victim in judicial custody in Unnao, and has asked the authorities to ensure the aggrieved family is not subjected to further harassment.

“The incident was reported to have happened a day after the alleged rape victim tried to immolate herself near the chief minister’s residence accusing BJP MLA Kuldeep Singh Sengar and his aides of gangrape,” the NHRC said today.

The National Human Rights Commission observed that the allegations, if true, raise a serious issue of violation of human rights of the victim’s family.

It has issued notice to the chief secretary and the director general of police of Uttar Pradesh, seeking a detailed report, including action taken against the “delinquent police officials”, who refused to register an FIR.

“The NHRC also expects from the DGP, an explanation for not communicating the custodial death to the commission within 24 hours. All the reports, including health screening report of the deceased at the time of his admission in the jail and medical treatment provided by the jail authorities, are to be sent,” the rights panel said in a statement.

They have been given four weeks to respond, it said.

The commission said it has also directed the chief secretary to “look into the matter personally and ensure that the aggrieved family is not subjected to further harassment and humiliation by the opponents who appear to be resourceful persons of the locality”.

“He (chief secretary) is also directed to monitor and expedite the magisterial inquiry which is underway,” it added.

The man, aged around 50, was rushed to a hospital from the district jail on April 8 night and died during treatment yesterday, an officials said. He was arrested on April 5 under the Arms Act, they added.

Significantly, a case had been registered against four persons a few days ago on a complaint by the wife of the deceased that he was beaten up.

Under fire, Chief Minister Adityanath has sought a report into the custodial death.

The Unnao superintendent of police yesterday said six policemen, including station house officer, Makhi, Ashok Kumar Singh, an outpost in charge and four beat constables had been suspended.

Uttar Pradesh Director General of Police O P Singh said a Lucknow Police team had been constituted to probe the entire matter.

The recent immolation bid by the woman was foiled by the police. She had alleged that the Unnao police had not registered a case against the BJP MLA despite her complaint and no action was taken, police said.

Sengar represents the Bangermau constituency in Unnao district, and has denied the charge. He also demanded a high-level inquiry and sought action against those guilty.

“After medical examination, the woman’s father was sent to prison,” the NHRC said.

According to media reports, on April 8, in the evening, he complained of stomach ache and the next day he died in the hospital at around 3.30 am, the NHRC said.

“According to media reports, the doctors, who examined the deceased after he spent two days in police custody, noted 19 injury marks. The news report also states that he was taken to hospital only when his condition deteriorated,” the rights panel alleged.
